finalizing the proposed Municipal Boundary Restructuring a mere two days after the Public Meeting, changing the Use of City Property Bylaw to allow (belatedly) Encampment Evictions, funding Ice Storm clean-up

It is particularly egregious for Council to be rushing through both the Municipal Boundary Restructuring and the Anti-Encampment Bylaws on Erev Yom Kippur, knowing that many of the people who would probably want to speak to it cannot attend, due to High Holiday celebrations

  • Winter Downtown Patios to be subject to all terms and conditions associated with the standard downtown patio program, with the following conditions:

    • Right of Way Activity Permits for Winter Downtown Patios will be issued to support breweries and restaurants to maintain their patios from November 16 to the second Thursday of April, with a minimum sidewalk clearance of 1.5m for pedestrian access and the understanding that approved patios will not require the relocation of City infrastructure, including but not limited to bollards

    • Adequate snow storage must be demonstrated

    • All other provisions within the Business Licensing Bylaw and the Snow Clearing (Downtown) Bylaw will remain in full effect during this period

  • Approved Winter Downtown Patios will be limited to a maximum of six businesses per year on a first-come first-served basis

  • The Winter Downtown Patio program is to be incorporated into the current Patio Program Fees Bylaw, such that program participants pay one $400 fee per year to participate in the Downtown Patio Program, and a lease rate of $0.40 per square foot per month, requiring applicants to only submit amendments to their ROWA permits to move between winter and standard patio permit requirements

⛺️‼️ Update to the Use of City Property Bylaw

  • Update the existing Use of City Property Bylaw to ensure they reflect current processes and practices related to encampment evictions (which have already been taking place - also, the original Bylaw proposed once again prevented people from giving away food, water, or other necessities of life - It appears that someone reminded Council that this got the City in trouble with the Ontario Human Rights Commission the last time they tried this, because the proposed Bylaw was updated same-day to include individuals in the exemption list of who could give away food, water, etc.)

  • Authorize the Legislative and Court Services Department (Enforcement Services) to apply to the Ministry of the Attorney General for set fines related to this new Bylaw, with fine amounts ranging from $100 - $1000 (instead of fining people money they don't have for not properly putting away garbage, it would make infinitely more sense to simply provide proper waste disposal stations)
